Yêu cầu chung về quản lý nước thải
Theo quy định tại khoản 2 Điều 72 Luật Bảo vệ môi trường 2020, yêu cầu chung về quản lý nước thải được quy định như sau:
- Nước thải phải được thu gom, xử lý đạt quy chuẩn kỹ thuật môi trường trước khi thải vào nguồn tiếp nhận;
- Khuyến khích tái sử dụng nước thải khi đáp ứng yêu cầu bảo vệ môi trường và mục đích sử dụng nước;
- Nước thải có thông số môi trường nguy hại vượt ngưỡng quy định phải được quản lý theo quy định về quản lý chất thải nguy hại;
- Việc xả nước thải sau xử lý ra môi trường phải được quản lý theo quy định của pháp luật về bảo vệ môi trường, phù hợp với khả năng chịu tải của môi trường tiếp nhận.
Quy định về quản lý nước thải
Căn cứ khoản 1 Điều 3 Nghị định 45/2022/ND-CP, xả nước thải ra môi trường là việc cá nhân, tổ chức xả các loại nước thải vào môi trường đất, nước ngầm, nước mặt và nước biển nội địa. ngoài cơ sở và khu sản xuất, kinh doanh, dịch vụ tập trung.
Căn cứ Mục 5 Chương VI Luật Bảo vệ Môi trường 2020, các quy định về quản lý nước thải bao gồm:
Thu gom và xử lý nước thải
Căn cứ Điều 86 Luật Bảo vệ Môi trường 2020, các quy định về thu gom và xử lý nước thải như sau:
- Các khu đô thị mới và khu dân cư tập trung; Cơ sở sản xuất, kinh doanh, dịch vụ, khu sản xuất, kinh doanh, dịch vụ tập trung, cụm công nghiệp phải có hệ thống thu gom, xử lý nước thải tách biệt với hệ thống thoát nước mưa, trừ trường hợp đặc biệt. do Chính phủ quy định.
- Quản lý nước thải tại các đô thị, khu dân cư tập trung được quy định như sau:
- Nước thải sinh hoạt phát sinh từ các tổ chức, hộ gia đình phải được thu gom và đấu nối vào hệ thống thu gom, xử lý nước thải;
- Nước thải phát sinh từ hoạt động sản xuất, kinh doanh, dịch vụ trên địa bàn đô thị phải được thu gom, xử lý sơ bộ trước khi đấu nối vào hệ thống thu gom, xử lý nước thải đô thị; Nước thải sau xử lý sơ bộ phải đáp ứng quy định của đô thị, khu dân cư tập trung hoặc quy định của chính quyền địa phương;
- Nước thải phát sinh từ hoạt động sản xuất, kinh doanh, dịch vụ tại các đô thị chưa có cơ sở xử lý nước thải tập trung phải được thu gom, xử lý bảo đảm yêu cầu bảo vệ môi trường trước khi thải sang nguồn tiếp theo. nhận được.
- Quản lý nước thải từ hoạt động sản xuất, kinh doanh, dịch vụ được quy định như sau:

- Wastewater from production, business and service establishments located outside urban areas, concentrated residential areas, concentrated production, business and service areas, industrial clusters that cannot be connected to the collection system, Wastewater must be collected and treated to meet environmental protection requirements before being discharged into receiving sources.
- Domestic wastewater generated from organizations and households in non-concentrated residential areas must be collected and treated on-site to meet environmental protection requirements before being discharged into receiving sources.
- Provincial People's Committees have the following responsibilities:
- Invest and encourage investment in building wastewater collection and treatment systems in urban areas and concentrated residential areas in areas under the investment responsibility of the State according to the provisions of law;
- Issue a roadmap for allocating land funds, investing or encouraging investment in building wastewater collection and treatment systems in urban areas and concentrated residential areas in cases where there is no wastewater collection and treatment system;
- Promulgate a roadmap and support policies for organizations and households in urban areas and residential areas to focus on building works and installing on-site wastewater treatment equipment to meet environmental protection requirements first. when discharged into receiving sources in case it is not possible to arrange a land fund to build a wastewater collection and treatment system in urban areas and concentrated residential areas established before the effective date of the Law on Environmental Protection 2020. enforce;
- Issue an implementation roadmap and policies to support the collection and on-site treatment of domestic wastewater generated from organizations and households in non-concentrated residential areas.
- The Minister of Natural Resources and Environment provides guidance on on-site wastewater treatment technology and techniques.
- The Minister of Construction provides guidance on technical infrastructure projects for wastewater collection and drainage in urban areas and concentrated residential areas specified in Article 86 of the Law on Environmental Protection 2020.
Waste water treatment system:
Pursuant to Article 87 of the Law on Environmental Protection 2020, regulations on wastewater treatment systems are as follows:
- The wastewater treatment system must meet the following requirements:

- Công suất hệ thống xử lý nước phải phù hợp với lượng nước thải tối đa phát sinh;
- Xử lý nước thải đáp ứng yêu cầu bảo vệ môi trường;
- Vận hành công trình xử lý nước thải theo quy trình kỹ thuật;
- Có phương án phòng ngừa, ứng phó sự cố môi trường đối với hệ thống xử lý nước thải; Điểm xả phải có tọa độ, biển báo, ký hiệu rõ ràng, thuận tiện cho việc kiểm tra, giám sát xả thải.
- Bùn thải từ hệ thống xử lý nước thải phải được quản lý theo quy định của pháp luật về quản lý chất thải rắn; Bùn thải có thành phần nguy hại vượt ngưỡng quy định phải được quản lý theo quy định của pháp luật về quản lý chất thải nguy hại.
